Which Plumbing Faults Cannot Wait in a Rental

Queensland's tenancy law splits every repair at a rented home into emergency repairs and routine repairs, and plumbing dominates the urgent list. The Act names these as emergencies:

  • a water service that has burst, or one leaking seriously
  • a blocked or broken toilet
  • a gas leak
  • a failure of the water supply or the gas supply
  • flooding or serious flood damage
  • a failed essential service or appliance, such as the stove, a heater or the hot water unit

Everything else is routine: the tenant reports the fault, and whoever manages the property has the fix carried out within a reasonable time. Work needed to satisfy the minimum housing standards is treated as urgent as well.

  1. Who gets called first

The lease names a nominated repairer and lists their number, and says who takes the first call: the manager, the owner, or that repairer. Reporting by phone is enough.

  2. When nobody answers

If that contact can't be reached within a reasonable time, the tenant, or whoever manages the place, can hire a qualified tradesperson, with the cost capped at 4 weeks' rent.

Flats dominate the housing stock here, so a burst line upstairs rarely stays one household's problem. Water runs down shared risers in the blocks around Sherwood Road and the station, and the manager usually hears about the leak from the tenant below.

The Conditions for Charging a Tenant for Water

Four conditions all need to hold before an owner can pass the whole water account across:

  • the property is separately metered, or its water is carted in
  • the fixtures pass the efficiency test in the next section
  • the lease makes the tenant responsible for the water account
  • the tenant is handed the account within four weeks of the owner receiving it

Miss that four-week deadline and the water bill can no longer be charged. Once the copy arrives in time, the tenant has four weeks to pay.

  1. What moves across

The bulk water charge set by the State, plus usage charges, can go to the tenant. Sewerage usage and fixed access charges remain the owner's.

  2. When the fixtures fall short

The owner then pays for what the Act calls a reasonable amount of the water used, and only the excess can be passed across. The Act never defines that phrase, so the two sides set a figure and record it as a special term of the lease.

Tap, Shower and Toilet Limits for Rentals

A Queensland rental counts as water efficient on three measures, and the test applies only where an owner wants the tenant to carry the whole water account:

  • every indoor cold tap, single mixer and showerhead flows at no more than 9 litres per minute
  • the toilet is dual flush, using 6.5 litres or less on a full flush and 3.5 litres or less on a half
  • the average flush volume is 4 litres or less, averaged across five flushes: a single full one and four half ones

Only indoor cold taps count: those over a hand basin, a kitchen sink or a laundry tub, single mixers included. Bath taps, outdoor garden taps and the feeds to washing machines and dishwashers sit outside the test.

Fixtures made from 2005 onwards carry the national rating label, the Water Efficiency Labelling and Standards scheme (WELS), and Queensland's tenancy authority suggests 3 stars or higher on them. That is advice, not law.

What a Rental Water Efficiency Check Covers

A water efficiency check walks the rental fixture by fixture: we measure each indoor cold tap, mixer, showerhead and toilet against the rental limits, noting any that fall short. Where a label is missing, we time the flow into a jug and calculate.

The WELS label on each fixture shows its stars and its consumption, so much of the check is reading and recording. Replacing taps or a cistern is regulated work, so a licensed plumber handles it; our tap replacement page covers the choices. Anyone may change a shower head, as long as the replacement meets the standard.

You get the readings only: no certificate, no written report, no sign-off.

  1. Access

Getting in is settled with the tenant, via whoever manages the property, before the plumber arrives. The tenant controls the home day to day, so the time and the way in are agreed in advance.

  2. Paperwork

Notifiable work carries its own trail: the licensee lodges a Form 4 with the QBCC inside 10 business days, and the person who booked us, often the agent, receives the duplicate.

  3. Meters

Where readings look wrong for the bills, a leak detection visit finds what the meter is quietly charging for. Gas work at a tenanted home finishes with its own paperwork, which our gas compliance certificates page explains.

Rental Plumbing Questions From Toowong

Who organises plumbing repairs at a rented place in Toowong?

Queensland's tenancy law puts the owner, or whoever manages the property, in charge of keeping the premises in good repair throughout the tenancy, and the tenant passes problems on promptly. A routine repair then gets fixed within a reasonable time, and a licensed plumber does the work.

What counts as an emergency repair under Queensland rental law?

The Act's urgent list covers a burst water service, a serious water service leak, a blocked or broken toilet, a gas leak and a failed water or gas supply. Flooding and a failed essential appliance for cooking or heating count too. Anything unlisted is routine, and work needed for minimum housing standards is urgent as well.

How many litres a minute can taps in a rental run?

Internal cold taps, single mixers and showerheads may each run at no more than 9 litres per minute where an owner charges a tenant for all water. Bath, garden and appliance taps are exempt. The limits are a billing test, not a rule for every rental.

Does a tenant in Toowong pay the whole water bill?

No, not by default. The full account moves across only where the home is separately metered and water efficient, the lease names the tenant as the water payer, and the account copy reaches the tenant within four weeks of the owner receiving it. Sewerage usage and fixed access charges remain the owner's.

What if a rental is not water efficient?

The owner then pays for a reasonable amount of the water used, and only the excess can be passed across. This applies where the home is separately metered and the lease names the tenant as the water payer. The Act never defines that phrase, so both sides agree a figure and record it as a special term.
